(CNN) – The U.S. Supreme Court has upheld an incontestable verdict on the conduct of the major cigarette companies over four decades: They are racketeers who carried out a conspiracy to deceive the public and target children with their deadly and addictive products.
The court on Monday declined to accept appeals from either side in the massive case that began when the Department of Justice filed suit against the tobacco companies in 1999.
Although the Obama administration and public health groups failed to persuade the justices to reconsider earlier rulings that limited the financial penalties and remedial measures the trial court ordered, the Supreme Court left intact the trial court’s damning judgment: The tobacco industry has illegally profited from selling products that cause disease and death.
The Supreme Court’s decision puts the responsibility squarely on elected officials to eliminate the tobacco industry’s harmful influence and take effective action to protect the nation’s health.
Congress and the Obama administration should fund a national public education and stop-smoking campaign, and the Food and Drug Administration must effectively exercise its new authority to regulate tobacco products.
State officials must redouble efforts to implement proven tobacco-control measures, including higher tobacco taxes, comprehensive smoke-free workplace laws and well-funded prevention programs.
The case stemmed from U.S. District Court Judge Gladys Kessler’s landmark 2006 decision that found the cigarette makers guilty of violating civil provisions of the Racketeer Influenced and Corrupt Organizations Act (RICO).
Kessler found that they had acted illegally when they “lied, misrepresented and deceived the American public, including smokers and the young people they avidly sought as ‘replacement’ smokers, about the devastating health effects of smoking and environmental tobacco smoke.”
The companies, Kessler concluded, “have marketed and sold their lethal products with zeal, with deception, with a single-minded focus on their financial success, and without regard for the human tragedy or social costs that success exacted.”
In short, they perpetrated the deadliest consumer fraud in history. And, Kessler found, they continue their deceptions to this day. The tobacco industry spends nearly $13 billion annually — $35 million every single day — to market its deadly and addictive products, often in ways that appeal to kids…

Every year 440,000 people die in the US from tobacco use and smoke-related diseases, which is approximately 20% of all deaths in the United States. Cigarettes kill more Americans than alcohol, car accidents, suicide, AIDS, homicide, and illegal drugs combined.
While not an obvious source of radiation exposure, cigarette smokers inhale radioactive material that, over time, contribute large radiation dose to the lungs. Worse, smokers are not the only ones affected by the radiation in cigarettes. Second-hand can be just as harmful to nearby non-smokers.
Naturally-occurring radioactive minerals accumulate on the sticky surfaces of tobacco leaves as the plant grows, and these minerals remain on the leaves throughout the manufacturing process. Additionally, the use of the phosphate fertilizer Apatite – which contains radium, lead-210, and polonium-210 – also increases the amount of radiation in tobacco plants.
The radium that accumulates on the tobacco leaves predominantly emits alpha and gamma radiation. The lead-210 and polonium-210 particles lodge in the smoker’s lungs, where they accumulate for decades (lead-210 has a half-life of 22.3 years). The tar from tobacco builds up on the bronchioles and traps even more of these particles. Over time, these particles can damage the lungs and lead to lung cancer.

Research carried out by the U.S. Centers for Disease Control and Prevention (CDC) revealed that cigarette brands produced by U.S. tobacco companies in comparison with cigarettes brands produced in other countries, possess higher levels of toxic chemicals that provoke cancer.
As concluded the CDC research team, the USA tobacco mixture comprises more cancer-causing substances than cigarettes manufactured in Australia, Canada, and the United Kingdom.

In the course of research scientists examined 126 smokers from Australia, Canada, and the United Kingdom. The examined smokers were aged 18-55 years and smoked daily around 15 cigarettes for the last 12 months.
The examined participants were devoted to “American Blend” cigarette brand for more than 3 months. The CDC team hasn’t specified what kind of U.S. brand was used, only stating that it as a popular “American blend”.
Among the brands that appeared in research were Players in Canada produced by Imperial Tobacco, Lorillard’s Newport, Marlboro produced by Philip Morris USA, UK’s Benson & Hedges and Winfield in Australia produced by British American Tobacco.
More than 2000 cigarettes butts were examined by the research team.
After examining cigarettes made in Canada, USA, Australia, and the United Kingdom, the scientists found out that tobacco products from United States identifying as ‘American Blend’ contain high levels of tobacco-specific nitrosamines and cancer-causing chemicals that favor the development of malignant tumors.
Whereas cigarettes made in other countries contained other types of tobacco that have shown lower levels of carcinogens.
In order to calculate the levels of TSNA, the researches measured the quantity of these substances in cigarettes butts, in saliva and urine of those smokers who participate in the research. They came to conclusion that smokers of cigarettes made in USA were exposed to three-time higher levels of carcinogens than smokers who prefer cigarettes brand from other countries.
“It is obvious that cigarette brands that are produced in different countries differ in methods of fags’ production and also in applied ingredients”, said Dr. James Pirkle, vice manager for science at CDC’s National Center for Environmental Health. “All of those tested tobacco products demonstrate high amount of cancer-causing substances, although, the study shows that the levels of tobacco-specific nitrosamines differ from nation to nation, and cigs made in U.S. contain the highest levels of this substances” the scientist concluded.
The obtained data is published in the latest ‘Cancer Epidemiology, Biomarkers & Prevention’ Journal.
The present research is one more proof showing the severe consequences of tobacco usage,
that is the major cause of preventable deaths all around the world, tacking the lives of more than
5 million people per year.
According to the recent report presented by the World Health Organization, more than 8 million people will die by 2030 if tobacco usage is not reduced.

ALBANY — New Yorkers who like to smoke will have to dig a little deeper to light up next month, after the Legislature passed a bill on Monday that will give the state the highest cigarette taxes in the country.

Kevin S. Parker of Brooklyn and the other 31 Democrats in the State Senate all voted to increase the tax by $1.60 a pack.
The new law, part of an emergency budget measure to keep the government running, adds another $1.60 in state taxes to every cigarette pack sold starting on July 1, pushing the average price of a pack to about $9.20.
The average price in New York City, which imposes its own cigarette taxes, will be even higher, nearly $11 a pack.
Those who prefer other tobacco products will also be forced to pay significantly more.
The tax on smokeless tobacco will more than double, to $2 an ounce from 96 cents an ounce, starting on Aug. 1. And the wholesale tax on cigars, dips and other kinds of tobacco will rise to 75 percent from 46 percent .
And in what may be the legislation’s most controversial provisions, starting on Sept. 1, the state will begin collecting — or try to collect — taxes on cigarettes sold on Indian reservations to off-reservation visitors, an issue that led to violent protests during the early 1990s.
One Indian chief has said that trying to collect taxes would be considered an act of war…

COE TWP. — A Shepherd woman is being treated for head trauma at Blodgett Hospital in Grand Rapids after leaping from a pickup because her husband refused to stop for her to purchase cigarettes about 7:30 p.m. Sunday, Isabella County sheriff’s officials said.
Jacklin L. Faber, 51, was the passenger in a GMC Sierra pickup driven by Michael E. Faber, 54, of Shepherd, and according to sheriff’s officials, when Michael Faber refused to stop for his wife to purchase cigarettes, Jacklin Faber “decided to jump out of the pickup while it was traveling down the road” on South Shepherd Road, south of Federal in Coe Township.
Sheriff’s officials said Michael Faber realized his wife’s intentions just before she jumped and was able to slow the vehicle to between 10 mph and 15 mph before she leapt.
Jacklin Faber suffered head injuries and was transported to Central Michigan Community Hospital and later airlifted by helicopter to Blodgett Hospital in Grand Rapids for treatment.
Jacklin Faber was listed in critical condition at Blodgett Hospital in Grand Rapids as of 2 p.m. Monday.
